Terms of service
These terms apply to services provided by DESKAUTOMATION, a proprietorship of Mukul Karale, Pune. A signed order or agreement with a firm takes priority over these terms where they differ.
The service
We provide software and setup for accounting firms: Inward, WhatsApp reminders and follow-up, and WhatsApp document intake. Scope, fees and support levels are agreed in writing with each firm.
The firm's responsibilities
- Message only its own clients, who have agreed to receive WhatsApp messages from the firm.
- Follow the WhatsApp Business Messaging Policy, WhatsApp Commerce Policy and Meta's terms.
- Keep the firm's WhatsApp Business account, number and Meta billing in its own name, and keep its login secure. We never ask for a firm's passwords.
- Check the content of messages before they are sent; the firm is responsible for what it sends to its clients.
- Follow professional rules that apply to it, including ICAI guidelines on communication with clients.
Fees
Setup and monthly fees are as agreed in writing. Meta charges for WhatsApp messages are billed by Meta directly to the firm; we add no markup.
Data
The firm owns its client data. We process it as described in our privacy policy. When the service ends, we delete the firm's data within 30 days, after giving the firm a chance to export it.
Availability
We work to keep the service running and fix problems quickly, but we do not guarantee uninterrupted operation. WhatsApp delivery depends on Meta, and on the firm's account standing and messaging limits.
Limitation of liability
To the extent the law allows, our total liability for any claim is limited to the fees the firm paid us in the three months before the claim. We are not liable for indirect losses, missed filing deadlines, Meta account restrictions, or penalties arising from the firm's own filings.
Ending the service
Either side may end the service with 30 days' written notice, or immediately if the other side seriously breaches these terms, including misuse of WhatsApp messaging.
Governing law
These terms are governed by the laws of India. Courts in Pune, Maharashtra have jurisdiction.
